Terms of Service

Please read these Terms of Service ("Terms") carefully before using the PikaFly mobile application (the "App") operated by Pika Holdings LLC ("PikaFly", "we", "our", "us").

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of Service

PikaFly is a budget-first travel search application that allows users to:

• Search flights from a home airport that fit a specified budget
• Discover same-day round-trip "day trips" for the upcoming weekend
• Calculate driving distances and fuel costs between cities
• Roll the dice on a random surprise destination within budget
• Save flights and drives for later
• Set budget watches that notify when new destinations under your budget appear
• Set price alerts for specific routes that notify when fares drop

3. Account Registration

• An account is optional for most search features but required to save budget watches and price alerts
• You may create an account using an email address and password, or by signing in with Apple or Google
• Creating an account requires confirming that you are at least 18 years old and that you agree to these Terms and the Privacy Policy
• You are responsible for maintaining the confidentiality of your account credentials
• You must provide accurate information when creating your account
• Usernames must be alphanumeric (letters, numbers, dashes, underscores only)
• You must be at least 18 years old to create an account

4. Acceptable Use

You agree NOT to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated scripts, bots, or scrapers to access the App
• Attempt to reverse engineer, decompile, or disassemble the App
• Circumvent any rate limiting, security, or access controls
• Impersonate other users or entities

5. Third-Party Services and Links

• The App displays search results from third-party providers (Google Flights, Google Hotels, Airbnb, etc.) sourced via SearchAPI.io
• We do not guarantee the accuracy, availability, or pricing of third-party results
• Booking flights, hotels, or other services is conducted through third-party websites; we are not a party to those transactions
• We are not responsible for the content, policies, or practices of third-party websites

6. Affiliate Disclosure

PikaFly participates in travel-affiliate programs, which may over time include but are not limited to airlines (for example Southwest), Skyscanner, Booking.com, Expedia Group (including Hotels.com and Vrbo), Airbnb, and Google Flights. Most booking links in the App currently open Google Flights or the airline's or provider's own website without affiliate tracking. Where an affiliate partnership is active and you complete a purchase through a tracked link, we may earn a commission at no additional cost to you.

• The price you pay is identical to booking directly through these services.
• Affiliate commissions do not influence our search results, sort orders, or rankings.
• We display flights and hotels based on your search criteria, budget, and filters — not based on commission rates.
• An affiliate tracking identifier may be appended to booking URLs so partners can attribute bookings back to PikaFly. This identifier does not contain any personally identifiable information about you.
• Affiliate partners may place cookies or tracking pixels once you leave the App to reach their site; we do not control those cookies, and they are governed by the partner's own privacy policy.

7. Pricing and Booking Disclaimer

• All prices displayed in the App are sourced from third-party APIs and are subject to change at any time
• Prices in budget and discovery searches (marked "from" or "Est.") are estimates based on recent fare data, not guaranteed fares; the final price is always shown by the booking provider before you purchase
• We do not sell flights or hotels directly
• Final pricing, availability, and booking terms are determined by the airline or hotel provider
• Fuel cost estimates are based on national average gas prices (sourced from EIA) and your vehicle's MPG; actual costs may vary
• Budget watch and price alert notifications are based on data checked periodically (typically several times per day) and may not reflect the price you see at the moment of booking

8. Intellectual Property

• The App and its original content, features, and functionality are owned by Pika Holdings LLC
• You may not copy, modify, distribute, or create derivative works based on the App without our written permission

9. Account Termination

• You may delete your account at any time through the Settings page
• We reserve the right to suspend or terminate accounts that violate these Terms

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or secure. Travel information and prices are provided for informational purposes only.

11. Limitation of Liability

To the maximum extent permitted by law, PikaFly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, revenue, or profits.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
