Terms of Service

Please read these Terms of Service ("Terms") carefully before using the PikaFly mobile application (the "App") operated by PikaFly ("we", "our", "us").

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of Service

PikaFly is a travel search and planning application that allows users to:

• Search for flights, hotel packages, and events
• Calculate driving distances and fuel costs between cities
• Compare flight and hotel prices from third-party sources
• Create and share local event listings
• Comment on events

3. Account Registration

• You may create an account using an email address and password
• You are responsible for maintaining the confidentiality of your account credentials
• You must provide accurate information when creating your account
• Usernames must be alphanumeric (letters, numbers, dashes, underscores only)
• You must be at least 13 years old to create an account

4. User-Generated Content

By submitting events, comments, or images through the App, you:

• Grant us a non-exclusive, worldwide, royalty-free license to display your content within the App
• Confirm that you own or have the right to share the content
• Agree not to submit content that is illegal, offensive, harmful, or infringes on the rights of others
• Acknowledge that user-generated content is visible to all App users

We reserve the right to remove any content that violates these Terms without notice.

5. Acceptable Use

You agree NOT to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Submit false, misleading, or spam content
• Use automated scripts, bots, or scrapers to access the App
• Attempt to reverse engineer, decompile, or disassemble the App
• Circumvent any rate limiting, security, or access controls
• Upload malicious files, scripts, or content designed to harm the App or its users
• Impersonate other users or entities

6. Third-Party Services and Links

• The App displays search results from third-party providers (Google Flights, Google Hotels, etc.)
• We do not guarantee the accuracy, availability, or pricing of third-party results
• Booking flights, hotels, or other services is conducted through third-party websites; we are not a party to those transactions
• We are not responsible for the content, policies, or practices of third-party websites

7. Pricing and Booking Disclaimer

• All prices displayed in the App are sourced from third-party APIs and are subject to change
• We do not sell flights, hotels, or event tickets directly
• Final pricing, availability, and booking terms are determined by the airline, hotel, or event provider
• Fuel cost estimates are based on national average gas prices and your vehicle's MPG; actual costs may vary

8. Intellectual Property

• The App and its original content, features, and functionality are owned by PikaFly
• You may not copy, modify, distribute, or create derivative works based on the App without our written permission

9. Account Termination

• You may delete your account at any time through the Settings page
• We reserve the right to suspend or terminate accounts that violate these Terms
• Upon account deletion, your personal data will be removed, but user-generated content (events, comments) may remain visible

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or secure. Travel information and prices are provided for informational purposes only.

11. Limitation of Liability

To the maximum extent permitted by law, PikaFly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, revenue, or profits.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
